Kentucky State University basketball coach Winston Bennett -fired Thursday for hitting a player – has been charged with fourth-degree assault, according to a local prosecutor.
Attorney Rick Sparks, an assistant in County Attorney Jim Boyd’s office, said Friday the charge is a class A misdemeanor, which carries a maximum penalty of $500 fine and up to a year in jail.
“There was enough alleged and corroborated to formally charge (Bennett),” Sparks said.
Bennett’s criminal defense attorney, Frank Mascagni of Louisville, said he accepted a criminal summons on Bennett’s behalf Friday morning at the Franklin County sheriff’s office. An arraignment is set for 9 a.m. Jan. 13, when Bennett will plead not guilty, Mascagni said.
Under a misdemeanor assault charge, Bennett could be tried in District Court by a panel of six jurors. Mascagni said he is optimistic the matter can be settled before that happens.
