City eyes Sunday beer sales

Sunday beer sales may be on tap for private charitable clubs such as the American Legion, Elks Club and VFW Post 4075 based on an apparent consensus reached by city commissioners at a special meeting Monday night.

Frankfort attorney Steve Bolton requested the City Commission change an ordinance to allow Sunday liquor sales for private clubs in much the same way Fiscal Court voted recently to allow liquor sales at the Frankfort Country Club.

However, City Solicitor Jim Higgs said he didn't believe current statutes permit a second-class city to pass such an ordinance.

Bolton said he believed commissioners could base an ordinance on an exception in the current statute but Higgs said it was his opinion that part of the statute, although unclear, would not allow for Sunday liquor sales in second-class cities.

"The statute clearly doesn't permit it in my opinion," Higgs said. "It's a lousily drafted statute that needs cleaning up. But the answer is to change the law."

But he said a statute does permit the sale of malt beverages on Sunday.

"We clearly have the authority to do it with beer but not with distilled spirits," Higgs said.
