Lawyer says murder suspect innocent, shooting accidental

An attorney for a Frankfort man accused of murdering his son said his client has been unfairly charged with murder for what was really an accident.

Harold "Rusty" Batdorff, 44, of 505 Owenton Ave., was arraigned Friday on a murder charge in Franklin Circuit Court after an indictment was returned in the case earlier this week.

Batdorff was originally arrested and charged Dec. 29 with the murder of his son, 24-year-old Brian T. Batdorff of 416 Holmes St.

However, Batdorff's attorney appointed from the Department of Public Advocacy, Matthew Browning, said his client is not guilty of murder.

According to the press release from Frankfort Police, Brian Batdorff died at Frankfort Regional Medical Center after being shot in the abdomen by his father in an incident at his home.
