UPDATE: KSU student pleads not guilty to murder charge

21-year-old from Louisville was on Thorobred football team

State Journal Staff Report Published:

The Kentucky State University student who allegedly shot a man to death in Lexington was arraigned Wednesday afternoon in Fayette District Court.

The suspect, Dynell Stewart II, 21, of Tierra Linda Drive, pleaded not guilty to murder, assault and wanton endangerment. His next court date is scheduled for Feb. 7 at 8:30 a.m.

Early Sunday morning in Lexington, Stewart allegedly pulled his vehicle alongside another containing three men and shot two with a .40-caliber pistol. One victim, who according to court documents was shot multiple times in the head, later died.

Stewart is being held without bond. He was arrested by the Frankfort Police Department and booked around 11 p.m. Monday. He is now lodged in the Fayette County Detention Center.

Stewart was a member of the Kentucky State University football team, said Felicia Lewis, a spokeswoman for the school. A 2012 roster shows that Stewart is from Louisville and previously attended Union College.

A statement from KSU said Stewart is still a student there, and the university is beginning to conduct its own investigation.

“Our sympathy goes to the family of the victim who has died because of this tragedy,” the statement said. “Also, we fervently hope for the full recovery of the second victim.”

The Fayette County Coroner’s Office said Allen Smith, 23, was pronounced dead at about 6 p.m. on Monday at the University of Kentucky Chandler Medical Center.

Records say the second victim, Jordan Orgeman, was shot once in the abdomen and is in serious condition at UK Medical Center.

A third passenger in the car, Anthony Garrett, told police he took cover during the shooting and heard 10 shots.

The shooting occurred around 3 a.m. Sunday near Tolly-Ho, a restaurant on South Broadway in Lexington. According to witnesses, the victims were shot while in a vehicle on Bolivar Street. Court documents say the victims’ car was parked at the time.

Video surveillance matched Stewart’s vehicle, which allegedly followed the victims’ vehicle and fled the scene after the assault.

  • Bodeen and Gunner, this is 1713 and I think that you should tell us what I said that was racist, besides the fact that I pointed out that your statements were. Just because someone brings it to your attention when you say racist statements, does NOT make them a racist along with you. It is not a cold virus...jeeze! Just one thing will do...

  • Bodeen this is Gunner and I think we know who is racist and it aint you or I!!!!!!!!!!! And that is the rest of the story...

  • bodeen, "I never admitted to being a DRUG addict 1713. not in this forum or any other forum because I never partake in drugs that we are talking about. I have admitted to being a smoker..." Dohhh! Denial is not just a river in Egypt. Shucks, cigarettes and other tobacco products are the most dangerous drugs out there, ask any doctor, nurse, chiropractor, college grad, Mom or anybody other than some smokers, and they will tell you the same thing. Tobacco products, used in exactly the manner intended, are extremely addictive to some people, a fact that your personal experience can attest to, and harms nearly every organ of the body because they are chocked full of Group A carcinogens. Mmmmm good! Hey, it is your choice to be addicted to these things, and as an adultI will fight for your right to do with your body as you see fit, as long as you don't try to make others do it along with you. Frankly, it is your sanctimonious attitude towards all other druggies that I have a problem with, as it makes you sound like a hypocrite. Smoking causes many diseases and reduces the health of smokers in general, including the following cancers: acute myeloid leukemia, bladder cancer, cancer of the cervix, cancer of the esophagus, kidney cancer, cancer of the larynx (voice box), lung cancer, cancer of the oral cavity (mouth), pancreatic cancer, cancer of the pharynx (throat), stomach cancer, emphysema, coronary heart disease (the leading cause of death in the United States), stroke, peripheral vascular disease, chronic airway obstruction by damaging the airways and alveoli (i.e., small air sacs) of the lungs. Smoking has many adverse reproductive and early childhood effects, including increased risk for infertility, preterm delivery, stillbirth, low birth weight, and sudden infant death syndrome (SIDS). Smoking is associated with the following adverse health effects: postmenopausal women who smoke have lower bone density than women who never smoked, and women who smoke have an increased risk for hip fracture than women who never smoked. The negative effects of ANY illegal substance PALES by comparison. Maybe if you talked about this inconvenient truth more it would make it easier for you to accept your current condition. Maybe not. I am jes' sayin'... ...................................................................................................................................................................................................................................................................................................................................................................................................................................................................... Roni made a mistake when he was a young single man without children, kinda like did with your DWI...and it was just a matter of luck that you didn't cause a wreck that killed somebody while you were thus impaired, or you would have a felony and criminal record too. I assume that you are now gainfully employed in spite of that fact because someone took a chance and backed you in order to gain another good employee. What are we to do with people who as kids make stupid mistakes and get in trouble after they become adults? Ruin any chance that they have of ever becoming gainfully employed and a productive member of society, or toss them aside with a big red F(lag) tattooed on their forehead so that everybody can steer clear of them, dooming them to a life of crime? I am glad that you are not a judge because your wisdom about how to handle such things is about as good as your wisdom in knowingly consuming carcinogenic drugs that you are addicted to. ......................................................................................................................................................................................................................................................................................................................................................................................................................................................................... I know how to read racist code when I see it. I am not taking up for Stewart...you don't read so good.

  • I never admitted to being a DRUG addict 1713. not in this forum or any other forum because I never partake in drugs that we are talking about. I have admitted to being a smoker & to DWI charge when I was a young single man without children. I have admitted to members of my family who are addicts & dealers. I've never hid the fact because I know drug abuse is wide spread & I don't think any family is without an abuser. Ksu was well aware of Ronis history & still backed him in order to gain another STAR PLAYER. All schools do it so Ksu isn't no different in that respect & when a player has left one school looking for another to play, it should send red flags up. Like I said, until it is anybody elses elder mother or aunt then I don't suspect that this is a big issue. I also never lumped all the students together, I'm just saying that KSU has a problem with "A LOT OF THEIR STUDENTS" "NOT ALL"! ......... Now, I was careful in my last post not to mention any race or color of the students who harassed my mother & aunt never & yet you call me a racist. ??????????? Thats the problem 1713, white man can't complain or make factual statements against any other race without you (or anybody else) labeling them a RACIST! The man in this story chased down three people in a car & violently shot & killed a young man with multiple headshots & seriously wounded another man while trying to kill him & tried to kill a third man. You take up for him & call me a DRUG ADDICTED RACIST because I agreed with Gunner, because he was right. LOL...... I think you missed your calling 1713 because you would had made a good defense lawyer :-)

  • Well, bodeen, what I first said about your post amounted to this: "bodeen, I read the article and I don't recall that your interpretation of what happened was based on anything reported or that has been reported or established. Do you have some insider info that you would like to share?" Where is the wild accusation in that? ......................................................................................................................................................................................................................................................................................................................................................................................................................................................................... You are making some pretty "wild accusations" now though, and although you admit your racial prejudices it still does not excuse you for lumping all KSU students in the same boat with those from 10 years ago just because they are black. How do you even know that they were KSU students...because they were black? And even if they were KSU students, you can't hang that on the school. ................................................................................................................................................................................................................................................................................................................................................................................................................................................................................. Some of these KSU kids come from pretty rough neighborhoods where everybody has a gun and they settle disputes with them as a first option...you know, like chazrigz wants ALL of us to do. ........................................................................................................................................................................................................................................................................................................................................................................................................................................................................ Nothing excuses those kids who accosted your family regardless of who they were and where they came from. But how do you expect KSU to "screen them" out? These are individuals that are making the noise, and your lumping them together with all of the other fine black kids that are at KSU is racist by nature, and if you think about it for a moment, you will agree. Would you do the same thing if a white football player at UK had shot somebody, so you lump all of the white students at that school in with him...I don't think so? That simple test determines if you are a racist...and if yo are, you got some more character development work to do. .................................................................................................................................................................................................................................................................................................................................................................................................................................................................................................................................................................... I don't know Roni Robinson personally, but he doesn't sound anything like this Stewart fellow...although you can't stick KSU or the big cities with that either, as Roni was home grown right here in Frankfort. I do know that he is just a few hours short of graduating and that his robbery was a long time ago when he was a kid, and he served his time and started back to school at KSU. He is going to have a rough time with a felony on his record, but that was of his own making. ......................................................................................................................................................................................................................................................................................................................................................................................................................................................................... The drug charges are BS and the height of hypocrisy, as we live in a city and state that is awash in dangerous and addictive (to some people) legal drugs. Our economy and tax base is highly dependent upon this drug trade, and our city is partly funded by drug money. Our farmers openly grow these very dangerous drugs all around us and drug pushers sell them in every corner market to Walmart. .......................................................................................................................................................................................................................................................................................................................................................................................................................................................................... You yourself have admitted on this forum to being a drug addict in the worst way, so for you to be looking down your nose at Robinson just because your drug of choice is sanctioned by the government (yet much more lethal than anything he was using) is like the pot calling the kettle black, doncha think? Pun intended.

  • 1713, my statements were from when the story first broke in the Lex herald & TV news & a lot more information was given then than what the state journal first posted. My "WILD" accusation about KSU defending this thug comes from the last thug they bent over backwards to help. You know, the RONI ROBINSON stories from the state journal! The one that ARM ROBS stores & THE DRUG DEALING, POLICE EVADING star football player? I'm not defending any poster but GUNNER is right about the NOISE that KSU students, especially the ones that the sports stars create. Yeah I'm a bit prejudice towards a lot of those students & anybody else would be also if their elderly mother & aunt were driving through EAST FRANKFORT PARK looking for a family member & were stopped by a couple dozen of these students & called wh@res, B!tches, White Trash ect. & told to get out of there. Several of them walked towards my mother & aunt screaming at them telling them to leave & threatenied with bodily harm. We are talking about two women in their sixties & early seventies but it doesn't matter if they were in their twenties. This happened around 8-10 years ago. Nobody wants trash & thugs like this around & I personally wished KSU would screen these Detroit & Memphis people better. Higher enrollment isn't worth this kind of crap & god only knows how much drugs is funneled into Frankfort from just those two areas but from my association with people associated with KSU, Detroit is a major source of the pain pill trade & Memphis speaks for itself. These students are bringing in their relatives by the busloads every month to deal their goodies.

  • This story is just another in a long list of why we need comprehensive gun control...far too many people are walking/driving around armed to the teeth so that any moment of conflict, the confrontation is immediately escalated to the use of extreme lethal force. America has more guns per capita than any other country in the world, with more than double the number than the next closest country of Yemen...this is American exceptionalism? And some say that what we need is more guns being carried around by more people, which is a totally dystopian vision. We tried that already in the wild, wild West. It is uncivilized.

  • Yeah, (punching down) that is what I said in my original post, "I don't think that is gonna work here gunner...got any more negative stereotypes that you want to interject here about something that you know nothing about? Why don't we wait for the evidence to surface before passing the death sentence down in "cases like this". Cases like what?" I didn't say that you wore saltine "glasses", I said that you had saltine "eyes"...you could always take off the glasses. Nobody is defending thugs in particular, I was saying that based on the very skimpy facts in the original story that your response was filled with a stereotypical racist tone...the one that you keep regurgitating every time a story comes up that involves people of color. I see patterns...

  • 1713, Did I hurt your feelings I'm rubber and your glue so I guess it stuck to you get your facts before you start something you know nothing about. I guess I'm looking through my saltine glass that you said I wore. Does your mom know that you are using a computer with out her permission because only a child would say some like your rubber and I'm glue is that the best you could come up with? Really? Quit defending these thugs and give them what is coming to them this is where I wish the guys in the car had a gun and returned the favor and then just maybe my tax dollars wouldn't go to defend and house and feed these piece's of crap for the rest of there life or the next 5 years of there life is which is all they will probably get. Take this money we spend on them and take care of the local animal shelters and the elderly things in life that deserve a second chance and not these thugs!!!!!!!!!!!!!

  • Perhaps, if more people involved WERE ARMED, there would be more carnage. :o(

  • gunner, I never said anything about race...you are the one looking for "patterns" in KSU students. What did you find in your search? Feeling a little defesive here? One of the oldest tricks in the book when it comes to racism is to use the to use the old "I am rubber, you are glue, what bounces off of me, sticks to you". So, when someone calls you on your search for "patterns" and stereotyping, you simply reverse it and accuse them of the same thing. Do you think that that ever works? ......................................................................................................................................................................................................................................................................................................................................................................................................................................................................... Race has nothing to do with my comments on this thread, as all that I said was that some of you guys were sure jumping to conclusions with the thinnest of evidence. bodeen was the only one who seemed to have more evidence than originally given in the SJ story. And even he is making some strange statements about KSU's investigation and them defending one of their own in spite of what the evidence may reveal. You boys are funny...and not in a ha-ha kind of way. I see patterns here that are ugli...

  • The state journal has been updating this story 1713 & now has the same info that I got from the lex. herald & tv news. I don't know what the victims did to this thug but as you can now see, he chased them down & shot up to ten times at three people & delivered multiple head shots to the deceased victim. There is nothing at all that would justify what this thug did. If he was assaulted prior to this incident or they robbed him, then he should had called the police instead of taking the law into his own hands. No sense in defending this thug anymore. Also, the KSU investigation is absurd. Didn't happen on their property or even in the same county but it wouldn't surprise me if they try to defend this thug as well.

  • Folks, let's face it, 1713 does not have an ORIGINAL thought. All she can do is copy and paste from the liberal media. That's why I don't read her posts anymore.

  • Ummm....anonymous_1713.....January 29, 2013 10:43AM.....Just because something is not written "into the story" does not mean that it is untrue. What did I say that was not true? Giving us "The Rest of the Story" is what guys like Paul Harvey made a very good living at doing......................I guess this means that only 1713 can "give us the rest of the story" (ie. create far reaching details that are not reported to fit what 1713 wants to say... What a double standard we have here!

  • Allen Smith was a sweet kid. I don't know what the circumstances were but he didn't deserve this.

  • 1713, I don't have to stereotype anyone the facts speak for themself, put blame where blame belongs. If you catch a fox in the hen house you don't blame the weasel for it you punish the fox and let the weasel go. And this fox is no angel and make him pay for what he has done just for once 1713 take the black and white out of the picture and look at what has taken place a life has been taken and no more birthdays for this person no more Christmas's for this person and no more son for a mother who loved him. 1713 why does it always have to be a race issue with you? You are one of the most prejudice person who ever post on this forum. I see a criminal and you see that the white man is out to get a black man why is that? If you where not prejudice then you wouldn't refer to the white police officer's in your wording instead you would refer to them as police officers. Until you quit seeing color then you will never get the big picture!

  • 810, nobody said that the KSU investigation was going to be the only one conducted here, did they? But they have an interest here in that one of its football team students was involved, and they have a police force staffed with commissioned officers that are better trained than our Sheriff's Office...so why not? Who knows what they may uncover in their investigation that the LFUCG police just don't spend the time to find out. I would dare say that the Lex. police have a whole lot more going on than this investigation. bodeen, I read the article and I don't recall that your interpretation of what happened was based on anything reported or that has been reported or established. Do you have some insider info that you would like to share? need4speed, "quite a bit" is a relative term. I can't recall all of those stories...can you refresh our memories? Did Mrs. Speed have any of that kind of trouble? What do you want them to do, cut off their fingers?

  • Based on stories in the SJ, It would appear that there is quite a bit of Rapin', Robbin', lootin', and shootin' coming out of KSU. Of course, this makes it terribly difficult on the young men and women who are there to get an education. And for the record, before the D man climbs my tree, Mrs. Speed has a Masters degree from KSU.

  • 1713.....In cases where people who are in a car driving down the road who poses no threat to anybody & then shot to death. Life snuffed out for no reason other than one person wanted them dead. I am all for self defense but following another car for the sole purpose of shooting the occupants isn't self defense. Of course we don't know the full story yet but some of the circumstances that we do know makes it hard to believe that that shooters life was in danger!

  • I'm pretty sure a KSU "investigation" is not going to mean a thing when it's all said and done. That's pretty much code for we're going to let this one play out in the judicial system.

  • I don't think that is gonna work here gunner...got any more negative stereotypes that you want to interject here about something that you know nothing about? Why don't we wait for the evidence to surface before passing the death sentence down in "cases like this". Cases like what?

  • At least Fayette County gets him. They do things different there & I don't think he will get the Franklin County Special of a PLEA BARGAIN FOR A CONVICTION WITHOUT JAIL TIME! I'm all for an EYE FOR AN EYE in cases like this.

  • Who cares that the university is investigating do they think it's going to make a difference in the outcome I'm sure they are going to use the defense he was a star football player and he should just get a slap on the wrist. How many other football or so called basketball stars from KSU have been in trouble with the law? Does anyone besides me see a pattern here? Well I'm sure he was abused as a child and know one loved him and he is misunderstood and he didn't mean to do it. Blaw, blaw some old story different person tired of hearing it. So don't sentence him to jail and let him get out on probation so he can get into more trouble and we will hear how he was a football star and we should give him a break. Tired of hearing the same old bu--sh-- make him pay for his crime and eye for an eye as the old testament of the bible says.
