A Frankfort man has pleaded guilty in Franklin Circuit Court to 11 counts of raping a 41-year-old mentally challenged and physically disabled woman for whom he was a primary caregiver. David Lee Carmon, 44, 739 Holmes St., entered his plea Friday, appearing in court bearded and teary-eyed. Carmon hung his head as he testified that he had oral sex and sexual relations multiple times between 2001 and 2006 with the woman. Assistant Commonwealth's Attorney Dana Todd said the woman, who is unable to move or speak, is "profoundly handicapped" by a condition that has "affected her since birth." Carmon, who has a sixth-grade education and worked part time at a furniture store and doing odd jobs prior to his arrest, admitted the offenses to police as they questioned him July 31, 2006, according to his testimony and court files. Carmon had been seen through a window, naked in the woman's room, wiping her with a towel, according the court file. He told police, "I've got nothing else to hide," the file said. He told police he had a tough life, dropping out of school to help out at home and care for his 11 siblings, four of whom are now deceased. He also told police he had been sexually abused as a young child and again as a teen, the file said.
Carmon was indicted Aug. 16, 2007, and had pleaded innocent at an Aug. 27, 2007, arraignment. He also faced one count of incest, but the charge was dropped.
Forensic psychologist Paul A. Ebben, in a letter to Carmon's attorney, said he believed Carmon might suffer from mild mental retardation, but thought Carmon to be fully competent. "There is no doubt in my mind that he knew what he was doing and what was happening in court," Todd told The State Journal. "It's always gratifying to bring a case to resolution, particularly when the victim cannot speak for herself, literally in this case." No one posted bond for Carmon, who is currently being held in the Franklin County Regional Jail. He will be sentenced July 11 and could face life in prison but will likely get 17 years, Todd said. "I don't know where exactly he will end up," Todd said, "But he's going to prison." Carmon is ineligible for probation or shock probation, and will be ineligible for parole until 85 percent of his sentence is complete, according to his indictment. "People with disabilities are particularly vulnerable," Todd said. "The commonwealth is thankful for Good Samaritans who came forward with this information." Comments

This is one sicko...let's not try to excuse the fact that he raped a disabled...I am assuming relative - as he was initially charged with incest. He knew right from wrong and I bet she's not his only victim. But please let's not call him a victim...he's a disgusting perpetrator.

I guess I'm not clear on my message, had this molested, retarded man with a 6th grade education had been attended to as a child by the proper authorities, he and his victim would not be in this position today. And if a frog had wings, he wouldn't bump his butt. You are making an illogical assumption here. You have to proof that had he received "help" he would not be in this position. The only way to guarantee your proposition would have been to institutionalize him at an early age. It is typical of the politically correct crowd to blame everyone but the accused for their actions.

Thank you answerman. I am so tired of seeing the blame put on everyone except the offenders. If everyone who had a hard life had to wait for the system to give them help before they were able to live a normal productive life, we would be in sad shape. Those who are able to pull themselves together will more than likely seek help on their own.

This wouldn't be headlines, it would not exist. I'm not defending what he did, it was wrong. My point is he was overlooked when he needed help and based on this story and the history presented in court the authorities had to know this.

Lets see, you are caught raping a totally handicapped female.
The first thing out of anybodies mouth is, I couldn't help myself because I was abused myself. BULLCRAP! If he had 11 siblings, who would have had time to sexually abuse him. Plenty of people have tough lives, quit trying to blame everyone but him. He did it and must suffer the consequences. Social services must be called in to determine how and why he was caring for this individual. I hope Dana Todd follows through with this for the lady's sake.

lets see, he was molested at a young age, must of never had a mental evaluation, he never finished grade school, he is mildly retarded, he was married, seemed like there is a law about about getting married to someone with mental developmental problems, oops missed that one too. Who let this guy be alone with this woman over an extended period of time? This guy never had a chance from day one. All his life it appears everybody just turned their head and now it escalated to this. Consider this, where did he learn his behavior patterns from. I doubt seriously he will live through prison. Speaking of prison , doesn't Ky have another mildly retarded man on death row.

Sexual abuse is act of aggression (or more simply a cry for attention through control). Even if he were made a eunuch, that would not deter his aggressive behavior from manifesting itself in another form of abuse.
How did he become her caregiver, with only a 6th grade education and (assuming from the article) he wasn't related to the woman? It seems that someone in the woman's family must have hired him for such a position, since the woman herself isn't physically able to make these types of decisions alone. If we're blaming people, I think the woman's family (if my assumption is correct) should share in the blame.

Sex offenders are never cured - they're treated. And perplexed is not entirely off base. Studies show that many abusers have been abused. These are not "self reporting" statistics but checks conducted regarding the abuser's background. I have worked in this field, so I'm not speculating as to what I'm posting.
