Sen. Julian Carroll, D-Frankfort, said he expects the medical staff responsible for his brother Norman's death will file an appeal in the $5.1 million judgment against them.

"In a verdict of that magnitude, I expect an appeal," Julian Carroll said Friday morning. "I'm hopeful the jury verdict will be sustained."

A jury in Louisville Thursday awarded Retha Carroll, the widow of Norman Carroll, $5.1 million in his death following surgery to alleviate Parkinson's disease symptoms.

Norman Carroll died Feb. 4, 2003, a week after surgery at Jewish Hospital.
Julian Carroll said the judgment was fair.

"Certainly his death was a shock to the family," he said.

The Courier-Journal reported the judgment went against the surgical team. The hospital had earlier been dismissed from the lawsuit by Retha Carroll.

The judgment went against Dr. Atul Barry, Dr. Dante J. Morassutti, the estate of nurse Carolyn Lowe and medical center anesthesiologists.

Retha Carroll's attorney, Hans Poppe, said the surgery was elective and could have been stopped at any time when Carroll had trouble breathing.

The patient went into a coma and his wife removed life support about a week later.
An attorney for Lowe's estate declined to talk about specifics of the case.

Attorneys for the others did not return calls for comment.
