Mother indicted for DUI

A mother accused of driving drunk with her young children in the car has been indicted by a Franklin County grand jury.


Sarah L. Insko, 27, of Owenton, was driving with two flat tires on April 9 and stopped in the Capital Plaza hotel garage, according to Commonwealth’s Attorney Larry Cleveland. 


Police say she blew a .131 on a blood-alcohol content test - well above the legal limit of .08.


Insko was indicted on charges of aggravated operating a motor vehicle under the influence of drugs or alcohol and two counts of first-degree wanton endangerment.


Cleveland said her children, ages 1 and 8, were in the car at the time. Before stopping, she had apparently struck something and damaged the two tires on the driver’s side of her 2003 Chevy Geo Tracker, Cleveland said.


Insko told police she’d driven from a bar in Georgetown, Cleveland said.


“I understand people’s kids drive them to drink, but I wish they wouldn’t drive to drink with the kids in the car,” he said.


Cleveland said he has prosecuted several similar cases recently.


The Franklin County grand jury also issued indictments Wednesday against:


>Robert G. Brooks, 45, of 741 Holmes St., first-degree possession of a controlled substance and possession of drug paraphernalia.


>Mark Allen Murphy, 20 of 855 Louisville Road, first-degree possession of a controlled substance.


>Thomas D. Niceley, 30, of Versailles, operating a motor vehicle on a suspended or revoked license, first-degree possession of a controlled substance and second-degree being a persistent felony offender.

Yes, I do believe indicting this woman on a felony is charge is overkill. I can honestly say that I am neither friends with her nor do I even know her. Certainly, I am well aware of the dangers that she caused if she, in fact, did what she's accused of.

However, it is overkill because she's being charged with two felonies when the DUI statute covers this exact situation and it is a misdemeanor. The fact that the kids were in the car makes it a DUI with an aggravator which enhances the penalties and increases mandatory jail time.

Like I said in my previous post, I do not condone this behavior in any way. I simply think that people should be charged appropriately and it appears, from the facts stated here, that she was not.

its called revenge for my earlier screwups on recent past cases which he let slip thru his hands and let guilty people free for far worse crimes..cant convict an alleged murder but sent an aggrivated case of DUI to grand jury....SPEND SOME MORE OF OUR HARD EARNED TAX DOLLARS...WTG LAR!!! have a drink on me...Im sure the city will pick up the comp care bill too if you need it...

Are you serious? You think its "overkill"? She could have killed her children and many other innocent people. That is ridiculous! What are you her best friend?

I think Mr. Cleveland's comment about children driving someone to drink was totally inappropriate. I wonder if this is an excuse for his own drinking problem. After all he did say he understands peoples kids drive them to drink.

Why indict this young lady? Are the WE 1sts really necessary? Why not call it what it is: a DUI with an aggrevator?

Please don't misunderstand me. In no way do I condone this behavior. In fact, I find it quite horrible. However, two felony counts seems like overkill to me when DUI with an aggrevator (for the kids being in the car) would seem more appropriate.
