Bankruptcies in Franklin County are up by 39 percent from this time last year, according to records from the Eastern District of Kentucky U.S. Bankruptcy Court.
At the end of October 2007, 197 had filed for bankruptcy protection " but as of Oct. 31 it's 274.
"It's been an unprecedented increase," Bankruptcy Court Clerk Jerry Truitt told The State Journal. "There doesn't seem to be any end to it."
Truitt attributed much of the increase to the economic recession, but said there are a number of other factors, such as divorces, catastrophic illnesses and auto accidents.
Bankruptcy filings for the entire eastern district have gone from 6,474 in October 2007 to 8,753 this year " an increase of 35 percent.
According to the Administrative office of the U.S. Courts, bankruptcy filings on the national level are set to outpace last year's total of 617,000. By June 2008, a total of 522,000 had filed for bankruptcy protection.
The bankruptcy process begins after a debtor consults with an attorney who specializes in bankruptcies. Debtors usually try and negotiate with lenders to reduce the interest or amount of principle before filing for bankruptcy, Truitt said.
"Filing for bankruptcy is a last resort," he said.
Then the attorney helps the debtor calculate all their debts " Truitt said, He said sometimes people incorrectly believe they can only file bankruptcy for some debts, not all. Even if they owe money to family members, that must be listed in the bankruptcy too, which is filed electronically, Truitt said.
Then, a third-party trustee is appointed to administer the estate and evaluate the assets and liabilities. Not all debts can be erased " taxes and student loans must be repaid.
Debtors are also required to undergo financial planning and credit counseling workshops, Truitt said.
Finally, the trustee submits a plan to discharge the debts and distribute any assets "including an inheritance.
Truitt said families in all socio-economic classes are being affected by the recession, including couples with a combined income of more than $100,000.
"It's not just blue-collar workers, it's across the board," Truitt said.
Truitt said he needs more staff and more judges to handle the increase in cases " he has 34 employees, two active judges and one retired judge who has been recalled to the bench.
Bankruptcy attorney Wendy Graney, an associate attorney at O'Bryan Law Offices, said her firm has seen a significant increase in bankruptcies. It handles cases in the eastern Kentucky, western Kentucky and southern Indiana districts.
"Our Frankfort office is busier than it has ever been," she said.
She said the most common forms of bankruptcy protection are Chapter 7 and Chapter 13. In Chapter 7 bankruptcy, assets are liquidated in order to cover debts, although debtors who are making payments on their home or car can usually keep them, Graney said.
Chapter 13 bankruptcy is similar to debt consolidation and is more useful for people who don't qualify for Chapter 7, she said. Those filing under Chapter 13 generally have more income, she said. The limit for filing under Chapter 7 is approximately $40,000, the median income in Kentucky.
There are also bankruptcy filings under Chapter 11 for businesses and Chapter 12 for farmers, although they are uncommon.
The biggest factor in the increase in bankruptcies is the economic recession, Graney said. Manufacturing companies are reducing overtime or closing their doors completely, she said.
"Some people would count on overtime as part of their regular income," Graney said. "It used to be great but now it's not there."
Graney also said she's seeing in increase in the number of debtors with more than $100,000 in income filing for bankruptcy protection.
"They were making great money and could afford to pay their mortgage and drive good cars," she said. "Now, if they can't afford their car how do they get to work?"
